By accessing our shop and making a purchase, you accept these Terms of Service.

Conditions of use

  • The customer undertakes to use this website lawfully and not to make fraudulent purchases.

  • MERXXA reserves the right to change the products, prices or services offered at any time.

Products and availability

  • The products sold at MERXXA are merchandise collections for bars, clubs, organisations, supporters' associations and other partner brands and projects.

  • Shop images are representative; slight variations in colour or finish may occur as a result of the production process.

  • Availability depends on made-to-order production and on material stock.

Purchase process

  • To place an order, the customer must provide valid contact and payment details.

  • Order confirmation by email constitutes a contract of sale between the customer and MERXXA.

Prices and taxes

  • All prices are shown in euros (€) and include Spanish VAT at the rate in force.

  • Shipping costs are calculated and displayed before checkout is completed.

Shipping

  • MERXXA ships through external courier companies.

  • Delivery times are estimates and may vary for reasons beyond MERXXA's control (strikes, logistical delays, public holidays and so on).

  • MERXXA is not liable for such delays, but will always support the customer in resolving problems.

Returns and refunds

  • The customer has 14 calendar days from receiving the order to exercise the right of withdrawal, except for products expressly excluded by law.

  • The conditions and procedure are set out in the Refund Policy, available on this website.

Limitation of liability

  • MERXXA is not liable for indirect damages arising from use of the products, or for delivery delays beyond its control.

  • MERXXA's maximum liability is limited to the total amount of the customer's order.

Personal data

  • The processing of personal data is governed by our Privacy Policy, in accordance with the General Data Protection Regulation (GDPR).

Applicable law

  • These Terms of Service are governed by Spanish law.

Neutrality and content

What MERXXA is. MERXXA is a technical merchandising service provider: we design, produce on demand, and run the online shop, payments, packaging and shipping on behalf of third parties (organisations, clubs, supporters' associations, cultural groups, content creators, businesses and individuals). The names, crests, logos, slogans, illustrations and any other identifying elements appearing on our products belong to their respective owners and are reproduced on commission and under the responsibility of the client supplying them.

Neutrality. MERXXA does not adopt as its own the ideas, opinions, or political, ideological, religious, linguistic, identity-based or sporting positions of any of the projects it works for. Designing, producing, selling or distributing an organisation's merchandise implies no connection, affiliation, sponsorship, membership, endorsement or support by MERXXA for that organisation or for what it represents. The relationship is strictly commercial and limited to the provision of services.

Plurality of clients. MERXXA works simultaneously with clients who may be rivals, compete in the same league, or hold opposing positions: supporters' associations of different sports clubs, cultural organisations of differing sensibilities, and projects in Catalan, Spanish or any other language. The coexistence of two or more clients in our catalogue, on our website or on our social media implies no relationship, comparison, equivalence or conflict between them, nor any position taken by MERXXA. We do not reject any client on grounds of language, origin, sporting allegiance or ideological outlook.

Responsibility for designs. The client commissioning or supplying a design warrants that it owns the design or holds the necessary authorisation, and that its reproduction does not infringe third-party rights. This applies with particular force to the crests, names, official denominations and images of sports clubs, to trade marks, characters, protected works and images of identifiable individuals. Being a supporters' association or a fan of a club does not in itself confer the right to use its crest or official name. The client is liable to MERXXA and to third parties for any claim arising from the content it supplies, and bears any resulting costs, damages and penalties.

Limits. MERXXA produces merchandise of any political, sporting, cultural, identity-based or linguistic outlook, and sporting rivalry, satire, humour and criticism are entirely welcome. The only limits are the law and respect for people: we do not produce unlawful content, or content that targets, insults, threatens or degrades specific individuals.

Right of refusal. MERXXA reserves the right to accept or reject any design, order or collaboration, and to withdraw a product from the shop at any time, without having to justify the decision and without this giving rise to any right to compensation. If the order has already been paid for, it is refunded in full.

Reporting inappropriate content. Anyone may report a product they consider contrary to this policy by writing to info@merxxa.com. We review every report and will withdraw the product where appropriate.
